General Terms and Conditions (GTC) for the webshop

1. Scope

1.1 These General Terms and Conditions (hereinafter "GTC") apply to all contracts between LEKU Versand OG (hereinafter "Seller") and its customers (hereinafter "Customer") concluded via the webshop www.growshop.at.

1.2 These Terms and Conditions apply to customers in Austria as well as in the European Union.

2. Conclusion of contract

2.1 The presentation of products in the webshop does not constitute a legally binding offer, but rather a non-binding invitation to order. By ordering a product, the customer submits a binding offer to purchase.

2.2 The Seller may accept the Customer's offer within 14 days by sending the Customer an order confirmation. The automatically generated order confirmation does not constitute acceptance of the offer.

2.3 The contract is only concluded when the seller accepts the customer’s offer by shipping the goods or enabling the provision of the digital content.

3. Prices and payment

3.1 All prices in the webshop are final prices and include statutory VAT and all other price components.

3.2 Payment can be made by bank transfer, credit card, PayPal, Amazon Pay or cash upon collection.

3.3 The customer undertakes to pay the purchase price immediately after conclusion of the contract.

4. Delivery and shipping costs

4.1 Delivery will be made to the delivery address specified by the customer.

4.2 Shipping costs are shown in the webshop and are borne by the customer unless expressly agreed otherwise.

5. Right of withdrawal and return

5.1 The customer has a statutory right of withdrawal. Details can be found in our cancellation policy.

6. Warranty and Liability

6.1 The statutory warranty regulations apply.

6.2 The Seller shall only be liable for damages caused intentionally or by gross negligence.

7. Data protection

7.1 The seller processes the customer's personal data in accordance with applicable data protection regulations. Further information can be found in our privacy policy.

8. Final provisions

8.1 Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

8.2 The place of jurisdiction for all disputes arising from or in connection with these Terms and Conditions and the contracts is Vienna.
